I doubt they did - the Animus and that guy's book is based off the theory of genetic memory which is a real scientific theory and wasn't created by Ubisoft or that author. And what you said is true - if Assassin's Creed is just a rip off of the same concept in that guy's novel, then why is the game so popular and the book isn't?
