I'm just going by memory on this, but I thought that poison can't be selected in open combat (when guards have surrounded you and their swords are out). Also, it can't be selected once a rooftop guard has noticed you. However, it can still be fired if a guard notices you while you are aiming the shot. Can anyone confirm?
